Dear Mr. Patterson:

The law is specific in requiring that professors of Military Science and Tactics must be officers of the Regular Army, and we have no qualified Negro Regular Officers available for assignment to Tuskegee. However, I have had the Judge Advocate look into the matter and his opinion is that we can designate the officer now on duty at the University of Alabama as nominal professor of Military Science and Tactics of Tuskegee, and send you a hand-picked colored Reserve Officer who will be designated officially as Assistant, but who will actually do the work.

If you have no objection to this method, which is the only legal way to continue the policy of a colored officer at Tuskegee, I wish you would let me know at once.
